These Terms and Conditions of Sale (“Terms and Conditions”) govern sales made through the ILL VINO website.

The business operates, in particular, under the trade name ILL VINO.

2. Scope

These Terms and Conditions apply to all product orders placed on the ILL VINO website by a consumer.

By confirming an order, the customer accepts these Terms and Conditions without reservation.

3. Products

ILL VINO offers for sale, in particular, wines, champagnes, spirits, beers and other products selected by the wine shop.

The essential characteristics of the products are described on the corresponding product pages of the website.

Photographs are provided for illustrative purposes only. Differences may exist between the photograph displayed and the product delivered, particularly with regard to the label, packaging or vintage where the vintage is subject to change.

Products are offered subject to availability.

If a product becomes unavailable after an order has been placed, ILL VINO will inform the customer as soon as possible and, where applicable, offer an equivalent product or a refund for the unavailable product.

4. Sale of alcoholic beverages

The sale of alcoholic beverages to minors is prohibited.

By placing an order containing alcoholic beverages, the customer certifies that they are at least 18 years old.

ILL VINO reserves the right to request proof of age in order to verify that the purchaser or recipient is of legal age.

If there is any doubt regarding the recipient’s age, delivery may be refused.

5. Prices

Prices are stated in euros, including all applicable taxes (VAT included).

Any applicable delivery charges are shown to the customer before the order is finally confirmed.

The prices applicable to an order are those displayed on the website at the time the order is confirmed.

ILL VINO reserves the right to change its prices at any time. Such changes will not apply to orders that have already been confirmed.

6. Orders

The customer selects the products they wish to purchase and adds them to their shopping cart.

Before confirming the order, the customer may review and modify its contents.

Confirming the order constitutes acceptance of these Terms and Conditions and creates an obligation to pay.

An order confirmation email is sent to the customer at the email address provided when placing the order.

ILL VINO reserves the right to refuse or cancel an order for legitimate reasons, including product unavailability, an obvious pricing error, suspected fraud or difficulties in verifying the customer’s age.

7. Payment

Orders may be paid by:

  • credit card;
  • bank transfer.

Credit card payments are made at the time the order is placed, according to the payment methods available on the website.

For payment by bank transfer, the order will be prepared and shipped once payment has been received, unless otherwise stated during the ordering process.

Bank details entered when paying by card are processed by the payment service provider used by ILL VINO.

8. Delivery

Orders may be delivered using the methods offered on the website, including:

  • a carrier;
  • Colissimo;
  • a delivery driver.

Delivery methods, service areas, estimated delivery times and delivery charges are indicated before the order is confirmed.

Delivery times indicated are estimates unless otherwise stated.

The customer must ensure that the delivery address provided when placing the order is accurate.

If an incorrect address provided by the customer results in a new delivery attempt, additional charges may apply.

9. Receipt of the Order

The customer is advised to check the condition of the parcel upon delivery.

If the parcel is visibly damaged, the customer is advised to make the appropriate reservations with the carrier and contact ILL VINO as soon as possible.

If a product is broken, damaged or does not conform to the order, the customer must contact customer service at cave@illvino.com, providing the order number and, where possible, photographs of the parcel and the products concerned.

10. Right of Withdrawal

In accordance with the regulations applicable to distance contracts, consumers generally have a period of fourteen (14) days from receipt of their order in which to exercise their right of withdrawal without having to provide a reason.

Customers wishing to exercise their right of withdrawal must send their request to:

Products must be returned as soon as possible and no later than fourteen (14) days after the decision to withdraw has been communicated.

The direct costs of returning the products are borne by the customer, unless otherwise provided by law or agreed otherwise by ILL VINO.

Refunds will be made in accordance with the applicable legal provisions.

The right of withdrawal does not apply to products subject to a statutory exclusion, particularly where the nature of the product or the manner in which it is marketed falls within such an exclusion.

11. Statutory Warranties

Products sold are covered by the applicable statutory warranties.

Consumers are notably entitled to:

  • the statutory warranty of conformity provided for under Articles L.217-3 et seq. of the French Consumer Code;
  • the statutory warranty against hidden defects provided for under Articles 1641 et seq. of the French Civil Code.

Any warranty claim may be sent to cave@illvino.com, specifying the order number and the problem encountered.

12. Retention of Title

The products remain the property of VSB until the purchase price has been paid in full.

The transfer of risk takes place in accordance with the statutory rules applicable to sales concluded with consumers.

13. Liability

ILL VINO shall not be held liable for damage resulting from improper use or improper storage of products after delivery.

Wines and spirits must in particular be stored under conditions appropriate to their nature.

ILL VINO shall not be held liable for failure to perform its obligations resulting from force majeure as defined by applicable regulations.

14. Intellectual Property

The texts, photographs, logos, illustrations, graphics, trademarks and other elements comprising the website are protected by intellectual property laws.

Any reproduction or use, in whole or in part, without prior authorisation is prohibited.

These Terms and Conditions are governed by French law.
